If you are an out-of-state parent whose daughter(s) or son(s) were arrested or received a ticket while going to school, college, university in Michigan, you must follow these suggestions:

  1. HIRE an experienced, aggressive attorney to take care of situation where it is happening. There are many different courthouses and judges in Michigan, and they all have their own particular way of working.   2. COMMUNICATION – If your daughter or son is in jail, you may not be able to talk with them. Bond terms generally limit out-of-state travel and this is an additional burden for someone who lives out-of-state and goes to school, college or university in Michigan. Again, it is important that you have an experienced attorney in your corner to help you with your needs, including your need for out-of-state travel, and other bond requests.

ZERO-TOLERANCE – If you are under 21 (or your daughter or son is under 21) and go to school, college, or university in Michigan, and you are caught driving with any alcohol in your blood system, you can get a DRUNK DRIVING TICKET for what is known as a ZERO-TOLERANCE VIOLATION TICKET. In Michigan, any person under 21 who is caught driving while having a BLOOD ALCOHOL CONTENT of .02 or more (which is very low) will get ticketed and arrested for DRUNK DRIVING – ZERO TOLERANCE VIOLATION.

DRUNK DRIVING – If you (or your daughter or son ) are caught driving in Michigan and have a BLOOD ALCOHOL CONTENT of .08 or more, you will be arrested for DRUNK DRIVING. DRUNK DRIVING is also known as Operating Under the Influence of Liquor (OUIL), Driving While Intoxicated (DWI), Operating While Visibly Impaired (OWVI), Operating While Intoxicated (OWI), Driving Under the Influence (DUI); or Operating With the Presence of a Controlled Substance (OWPCS), depending on the circumstances.

MINOR IN POSSESSION – If you (or your daughter or son) are under 21 and get caught with alcohol in Michigan, you will likely be ticketed for Minor in Possession. This is a MISDEMEANOR which means it is a crime and that you may be sentenced to jail, in addition to fines and costs.
