5 Things You MUST NOT DO if Arrested

  1. DO NOT SAY ANYTHING. Once you have been arrested, you are not going to talk your way out of it. So KEEP YOUR MOUTH SHUT.
  2. DO NOT BE RUDE OR OFFENSIVE. The police have all of the power once you are placed under arrest. There is no point in making the situation worse by getting into it with the police. This can only hurt you; sometimes literally. it is best to politely cooperate.
  3. DO NOT RUN. Once the police have decided to arrest you, even shrugging your shoulders to make it more difficult for them is considered a crime (Resisting and Obstructing). If you actually run from them, it can turn into a felony (Fleeing and eluding). This can happen whether you run on foot or in a car. It is a serious offense to run from the police, once they make it known they are chasing you. Again, it is best to politely cooperate.
  4. DO NOT WAIVE COUNSEL. Once you are arrested, it is in your best interest to let an experienced, licensed attorney help you make sure you make informed decisions about your situation. You need to understand what you are doing and an experienced attorney can help you better understand what to do. You should not make any statements without your attorney present.
  5. DO NOT TALK WITH WITNESSES. Any talking with witnesses, after you’ve been arrested, can cause harm to your case. Imagine anything you say to a witness being told back to a jury by that same witness. It will look BAD. In any case, you CANNOT CONTROL what a witness will say you said. You need to let an experienced attorney help you get the information from witnesses in a way that can help you. Again, you need a licensed attorney to make sure you do not inappropriately approach any witness.
